TN NAFTA Professional Workers
On December 8, 1993 the United States Congress approved the North American Free Trade Agreement(NAFTA). Following this agreement the TN classification was created to permit qualified Canadian and Mexican citizens to enter the U.S for purposes of temporary employment in a NAFTA approved professional occupation.
TN Visa for Canada and Mexico
There are different rules for Canadian and Mexican citizens who wish to apply for TN classification status. Canadian citizens are not required to apply for a TN visa at a U.S. consulate where as a Mexican citizen should apply directly at a U.S. embassy or consulate in Mexico. General Eligibility for TN Status
- You must be a citizen of Canada or Mexico
- The position requires a NAFTA professional
- Accept a full-time or part-time job with a U.S. employer
- Have the required education or experience for the qualified job or profession
TN Visa Term Limit
A person admitted as a TN non immigrant may remain in the United States for a maximum of three years. At the end of this period the individual must seek readmission in TN non immigrant status or apply to USCIS for an extension of stay in the U.S. Extension of stays are in increments that do not exceed three years. There is no limit on the number of times a Canadian or Mexican citizen may apply for a TN visa.
Spouses and Children of TN non immigrant visa holder may be admitted to the United States as a NAFTA dependent. The may be granted non-immigrant status but are not allowed to work.
