H-1B General Requirements

The prospective employer must submit a Labor Condition Application(LCA) to the Department of Labor(DOL) on behalf of the foreign national they intend to hire. A minimum of a bachelor’s or higher degree or its equivalent is normally the minimum entry requirement for the position. Professionals in fields such as Engineering, Architecture, Business and Health Care are considered to be in a specialty occupation.
