The United States maintains a treaty of commerce and navigation with certain countries that allow nationals of those countries to be admitted to the United States to engage in international trade on his or her own behalf. This agreement between the U.S. and foreign countries is commonly known as the Treaty Trader Visa (E1).

A treaty trader who is currently residing in the United States in a lawful non-immigrant status may request a change of status to E-1 classification by filing form I-129. The treaty trader may also file form I-129 on behalf of an employee that is also in the United States in a lawful non-immigrant status.

Qualifications of a Treaty Trader

The treaty trader must:

  • Be a national of a country which has a treaty agreement with the United States.
  • Carry on substantial trade.
  • Trade must be between the United States and the treaty country from which the applicant is a national.

Qualification of an Employee of a Treaty Trader

An employee of a treaty trader must:

  • Be the same nationality of the Treaty Trader.
  • Employed in an executive or supervisory position or in a position with special qualifications.
