First Preference EB-1 employment-based immigration is reserved for those persons of extraordinary ability, are an outstanding professor or researcher, or are a multinational executive or manager. Each of these three occupational category has certain requirements that must be met.

EB-1 for Extraordinary Ability

Persons who are able to demonstrate extraordinary ability in the sciences, arts, education, business, or international acclaim must meet 3 of 10 criteria below. Achieving an award such as a Pulitzer, Oscar, Olympic Medal or similar award will suffice. You must be recognized in your field through extensive documentation and no offer of employment is required.

Criteria for Proof of Extraordinary Ability

You must provide evidence of 3 out of the 10 listed criteria as stated by the USCIS:

  • Receipt of lesser nationality or internationally recognized prizes or awards for excellence
  • Membership in associations in the field which demand outstanding achievement of their members
  • Published material about you in professional or major trade publications or other major media
  • Have been asked to judge the work of others, either individually or on a panel
  • Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field
  • Authorship of scholarly articles in professional or major trade publications or other major media
  • Work has been displayed at artistic exhibitions or showcases
  • Performance of a leading or critical role in distinguished organizations
  • Command a high salary or other significantly high remuneration in relation to others in the field
  • Commercial successes in the performing arts
